Thank God everyone's OK! Make sure you guys get thoroughly checked out and don't foget your four-legged friend. Keep your spirits up the next Mav will be even better and sweeter.

You showed more restraint than I think I would have. I think she would have had a broken cell phone cause I would have yanked it outta her hand and smashed it on the ground.

Wow ... so sorry to see this. My stomach hurts a bit reading this.

Wishing all of you and your Mav a speedy recovery.

Good self-restraint Bryant.... I would have been tempted to do a two-step on that phone.

F!@#$% cell phones. Did she get charged? Guess you cant prove she was on the phone? What if it was a kid crossing the road instead of your car? People truly are STUPID.
I think people feel to safe in todays cars and take it for granted.

Bryant, if that kid was on a cell phone, I would make her a lot poorer and think next time when she wants to talk and text instead of paying attention. Just glad you and Mashori and the dog are ok. How about that dent in your head, any lasting damage?

I am so sorry that this happened to your car! I'm glad both of you and the dog got out relatively Ok. This kind of thing is always in the back of my mind when I'm driving my Maverick! There are some totally inept drivers here where I live! The car looks fixable. I hope it is!

if the highway patrol that responded had checked the call log time or the text log times on her phone they would have been able to charge her. i don't know if they did. i could stand to even look at her.
now all im concerned about is getting an appropriate amount from the insurance company. my insurance company wanted to take the car to a body shop for an estimate. they even were going to use the shop i wanted. i was thinking about it and asked if the shop (a shop i rebuild diffs for) would come to my shop to estimate it. they said yes and the insurance rep said that is ok. so far so good.
i have heard stories of cars going to body shops and having parts like gauges air filter etc. stolen off of them. and don't want to deal with that.

Can't they still be persuaded to check the logs and charge her? Those logs don't go away.

Too bad you dont have Hagerty Insurance. You would have no question in your mind how much youd be getting for the car. Only question would be how much you canbuy the car back for to get the parts for the next body.

using a cell phone while driving texting or talking is illeagle in here in California. as far as im concerned her problems with the law are her problems. im just concerned about the insurance and am not afraid to get my lawyer involved the moment insufficient money settlement is offered
