I finally have a template site up....still needs lots of work...my artistic gene died long ago. That is what i heard but i think that may be for businesses......I hope. guess i will find out...and I think that was for mustang in the name to. Robert
Ford is cracking down on anyone using one of their trademarks in business names, clubs, magazines and web sites. They are starting with Mustang but intend to go after all of the "trademark infringement" groups, businesses and individuals. Your best bet would be to use a name that does not include the words "Ford" or "Maverick".
ford's going to get there core of supporters all po'd and there going to start losing sales from a lot of ex diehard ford people.
Maverick may or may not be ok. In the case of Ford v. Pep boys regarding the Futura name, it was ruled that Pep Boys could retain their naming rights even though Ford still used Futura as a trim level on the Aussie Falcon. So, the fact that there is a Ford of Europe vehicle named the Maverick may or may not be applicable to another passenger car. Who knows... Ford lost Futura and GT40 because they didn't defend the naming rights. I would rather see them sue people for the mustang name rather than have someone else try to steal the name and make a crappy mustang. There are a couple of sticky points when it comes to copyright and trademark law. If you allow people to use the name for free, or at a value below what is considered reasonable, then that is not considered actively defending the name and you forfeit rights to it. There is also a context clause to be considered. For instance, you can use the mustang name as long as it doesn't pertain to anything automotive and be ok. So, if someone would like to use the name mustang they have to pay Ford a fee considered "reasonable" based on the value of the product. This is also why the new GT500 doesn't say Cobra on it anywhere. Anywho, just to stay on the safe side it's always best to come up with something original when naming anything.
